Colleges are increasingly performing criminal background checks on student applicants, as part of their student approval and acceptance process. Although colleges often have specific requirements, based upon the student candidates, and the programs for which they are being considered, crimes involving harm or violence to an individual or property are generally the criminal records that require particular review. It is also important to ensure that no student applicant is an “SDN,” on OFAC, or on any “watch-list,” such as FBI Most Wanted, INTERPOL, FBI Most Wanted Terrorist, National Sex Offender Registry, to name just a few of the myriad “watch-lists” that should also be included in any student background check.

Certain criminal records should always disqualify anyone from becoming a student. Specifically, if someone is an SDN, doing any business with that person, including allowing them to be a student, could subject the college or the appropriate college employee(s) to millions of dollars in civil and criminal penalties, and a conviction can result in the additional penalty of ten years of federal prison time, per occurrence. Other crimes can generally be handled by the college’s admission policy, based upon their risk mitigation tolerance and needs. However, not checking for SDN’s is truly not an option.
